    Trademark이란 무엇인가요?

    정의

A trademark is a legally protected brand identifier — typically a name, logo, slogan, or combination — that distinguishes your goods or services from competitors in the marketplace.

Trademarks are registered with the USPTO (in the US) or equivalent national offices and must be used in commerce to maintain protection. Registration gives the owner exclusive rights to use the mark in connection with the registered goods and services, the right to use the ® symbol, and legal presumptions of ownership in infringement disputes. A trademark search should be conducted before launching any brand name to identify potential conflicts with existing marks. Registration is not automatic — it requires application, examination, and often a period of opposition from other mark holders. Without registration, you may have some common-law rights, but enforcement is significantly harder.

    왜 중요한가

Launching a brand without checking trademark availability is one of the most common — and costly — startup legal mistakes. Receiving a cease-and-desist after investing in brand development, marketing, and domain acquisition can force a complete rebrand at significant cost. An IP attorney can conduct a comprehensive trademark search, assess risk, and file your application correctly.
